Short-term commercial lease: The Walloon region follows Flanders…
On 14 March 2018, the Walloon Parliament adopted draft legislation to provide for short-term commercial leases in the Walloon region.
As with the regime set up in Flanders by the decree of 17 June 2016, the Walloon legislature intends to reflect the development of “pop-up” shops by introducing a secure legal framework.
Short-term commercial leases will not exceed one year. In the event of renewal or of the tenant’s staying in the premises after the year, the lease initially signed will become a 9-year commercial lease within the scope of the loi du 30 avril 1951 legislation on commercial leases.
The tenant can terminate the short-term lease at any time by giving a year’s notice.
The draft legislation, which will come into force two months after it is published in the Moniteur Belge, can be seen on the website of the Walloon Parliament (décret sur le bail commercial de courte durée).
Flanders has had a similar mechanism since 1st September 2016 (see the décret du 17 juin 2016).
